Wrongful Death

PHOENIX WRONGFUL DEATH ATTORNEY

Losing a loved one is always difficult, even if it was expected.  When the death of a family member is unexpected, such as in a car accident, accidental drug overdose, or just being at the wrong place at the wrong time, it can leave a family in shock and disbelief.  Being unprepared for the death of anyone in your family brings about its own hardships and grief, especially if it was a major provider in the family or, worse, a child.

A person or company that has acted wrongly and, directly or indirectly, caused the death of another person deserves the consequence of a wrongful death claim to discourage them from this behavior in the future.  You have a right to bring a lawsuit against the guilty party.  We encourage you to pursue this right which may indirectly prevent another family from the same heartbreaking loss you have suffered.

Some arguments against wrongful death lawsuits and subsequent financial compensation try to make the surviving family feel discouraged or wrong, saying that a lawsuit won’t bring your loved one back.  It is true that a lawsuit won’t bring your family member back, but you have a right to show the person or company that what they did was wrong and to fight on your loved one’s behalf.

If you wish to file a wrongful death claim, the law firm of Moore Injury Law would be proud to represent your family and the interests of your dearly departed loved ones. No amount of financial compensation can reverse a fatal accident or undo the unthinkably negligent act that caused your loved one’s death. But a wrongful death settlement could go a long way toward helping surviving family members get by, pay off outstanding medical bills, and receive some level of justice.

WHAT ARE EXAMPLES OF WRONGFUL DEATH?

Wrongful death is defined as the death of a human being as the result of a wrongful act by another person, group, or company.

Wrongful acts which can cause a victim’s death could include:

  • Airplane crashes or other accidental death in aviation.
  • Boating accidents.
  • Car accidents, truck accidents, and motorcycle accidents caused by disobeying traffic laws.
  • Causing a death in the act of another crime.
  • Chemical exposure or toxic chemicals causing a fatal illness.
  • Criminal case which featured wrongful death actions in addition to other charges.
  • Defective pharmaceutical medications which result in sickness and death.
  • Defective products that should have been recalled or never put to market.
  • Drunk driving accidents and accidents caused by those under the influence of alcohol or drugs.
  • Inadequate or negligent security measures.
  • Intentional attack, assault or battery on another person.
  • Landlords exposing tenants to unsafe fire regulations or exposure to molds or asbestos.
  • Mechanical defects or improper maintenance resulting in wrongful death.
  • Medical malpractice, such as surgical errors, incorrect diagnoses, improper treatment, and lack of informed consent to the risks of certain health care procedures.
  • Murder or manslaughter.
  • Negligence, such as careless driving or mislabeled packaging in the case of a company.
  • Pedestrian accidents.
  • Railroad accidents.
  • Slip and falls and other accidents on private or business property.
  • Workplace accidents, whether they be in known high-risk jobs or otherwise.

A wrongful death suit is a civil lawsuit that can be brought against an individual even if they already have a criminal case pending in the same matter.  Additionally, a wrongful death suit is one of the only ways that a company can be held responsible and liable for negligence or product defects that cause death.  This type of tort claim is an important incentive for companies to act with greater care with regard to potentially hazardous products and services.

It isn’t always clear who is at fault in cases where multiple companies are involved in a persons wrongful death. The Phoenix wrongful death law firm Moore Injury Law will advise whether you have a legitimate wrongful death case.

HOW CAN A WRONGFUL DEATH LAWYER HELP YOU?

If any loved ones or family members fell into some unfortunate, fatal accident, you may be able to recover compensation and punitive damages on behalf of the wrongful death victims. If you are the surviving spouse, surviving child, or one of any number of other close surviving family members, you have the legal rights to pursue lost income (and future earnings which would have come from the victim’s income) to help pay for medical bills, funeral and burial expenses, as well as compensation for pain and suffering caused as a result of the wrongful deaths.

The deceased person cannot speak for themselves anymore. And it would be understandable if you are too overwhelmed by mental anguish to want to argue in court about medical expenses and punitive damages with the attorneys representing the responsible parties.

For this reason, as well as in the hope of any family members or beneficiaries receiving all compensation that the defendant owed them, it is advisable to seek the legal representation of a personal injury law firm with experience in bringing wrongful death claims to court.

With a successful wrongful death lawsuit, your attorneys’ law firm may pursue compensation from the negligent party or their insurance company by way of a civil claim, personal injury claim, and/or wrongful death claim. This compensation could lend financial support to a surviving spouse or other beneficiaries by helping to pay for lost wages, financial losses which would’ve come from future earnings, funeral expenses, medical expenses, and mental anguish caused by the person’s death.

GETTING JUSTICE FOR VICTIMS OF WRONGFUL DEATH CLAIMS

It is wrong that gross negligence or misconduct caused a fatal accident, robbing you of a close loved one. It is wrong that the victim’s family not only needs to contend with the pain and suffering of their loss but must also pay off funeral expenses, medical bills, and any financial issues left unresolved at the time of their loved one’s death. It is wrong that it often comes down to the family of the deceased taking legal action by filing a wrongful death lawsuit in order to recover compensation for any fatal accidents.

And that is why it is, in every meaning of the words, a wrongful death.

What happened to you and your deceased loved ones was wrong, and, as your Arizona wrongful death attorney, Moore Injury Law will help you file wrongful death suits that could potentially better help you through this incredibly difficult time.

If you or other beneficiaries want to hold at-fault parties accountable, it is important that they act fast before any statute of limitations runs out. WHO CAN BRING A WRONGFUL DEATH CLAIM IN ARIZONA?

According to the Arizona Revised Statutes, an action for wrongful death can be brought by the following surviving relatives or immediate family members:

  • Husband or wife
  • Child
  • Parent or guardian
  • A personal representative acting on behalf of the surviving husband or wife, children, parent or guardian, or on behalf of the decedent’s estate if none of these relatives have survived

WHAT KINDS OF DAMAGES MAY BE AWARDED IN A PHOENIX WRONGFUL DEATH LAWSUIT?

According to the Arizona Revised Jury Instructions, a victim in a wrongful death case is entitled to recovery for the following damages:

  • The loss of love, affection, companionship, care, protection, and guidance since the death and in the future.
  • The pain, grief, sorrow, anguish, stress, shock, and mental suffering already experienced
  • The income and services that have already been lost as a result of the death, and that are reasonably probable to be lost in the future.
  • The reasonable expenses of the funeral and burial costs.
  • The reasonable expenses of necessary medical care and services for the injury that resulted in the death.

Creditors of the deceased have no right to any award received in a wrongful death lawsuit except if the suit is brought on behalf of the decedent’s estate.

Many of the above damages are difficult to measure in monetary terms.  Wrongful death attorney Lew Moore will analyze and seek appropriate compensation for your damages.   Your damages should help ease your suffering, knowing that monetary damages are the only damages available for the wrongful death of a loved one.
